美国ITC发布对光动力治疗系统及其组件和与之结合使用的药品的337部分终裁

2026年5月6日，美国国际贸易委员会（ITC）发布公告称，对特定光动力治疗系统及其组件和与之结合使用的药品（Certain Photodynamic Therapy Systems, Components Thereof, and Pharmaceutical Products Used in Combination with the Same，调查编码：337-TA-1411）作出337部分终裁：经过复审，确认本案存在侵权，发布有限排除令和禁止令，终止本案调查。

2024年7月26日，美国国际贸易委员会（ITC）投票决定对特定光动力治疗系统及其组件和与之结合使用的药品（Certain Photodynamic Therapy Systems, Components Thereof, and Pharmaceutical Products Used in Combination with the Same）启动337调查（调查编码：337-TA-1411）。

2024年6月26日，美国Sun Pharmaceutical Industries, Inc. of Princeton, New Jersey向美国ITC提出337立案调查申请，主张对美出口、在美进口和在美销售的该产品违反了美国337条款（侵权美国注册专利号11,697,028、11,446,512），请求美国ITC发布有限排除令、禁止令。

美国Biofrontera Inc., Woburn, MA、德国Biofrontera Pharma GmbH, Leverkusen, Germany、德国Biofrontera Bioscience GmbH, Leverkusen, Germany、德国Biofrontera AG, Leverkusen, Germany为列名被告。
